Representation Before Debt Recovery Tribunals and the Debt Recovery Appellate Tribunal.

Debt Recovery Tribunals adjudicate claims by banks and financial institutions for recovery of dues above a specified threshold. For borrowers, co-borrowers, and guarantors, DRT proceedings can result in recovery certificates, attachment of assets, and auction of properties — making early and effective legal representation critical.
Dr. Shamsuddin served as Presiding Officer of the Debt Recovery Tribunal, Aurangabad, from 2009 to 2013, with additional charge of DRT Pune, DRT Nagpur, and DRT Mumbai. His experience on the bench — seeing how DRT proceedings are conducted and how decisions are reached — gives this firm a perspective that few advocates can match. That experience directly informs the way we approach DRT matters on behalf of our clients.

We represent borrowers and guarantors in original DRT proceedings and in appeals before the Debt Recovery Appellate Tribunal (DRAT). We also advise on the intersection between DRT proceedings and SARFAESI actions, where banks may simultaneously proceed under the Securitisation Act and before the Tribunal.

Experienced Representation in Debt Recovery Tribunal Proceedings

Initial Response to DRT Notice
Step 01

When a DRT summons or notice is received, the timeline for response is fixed and short. We advise on the legal position, identify available defences, and ensure that the written statement is filed within the stipulated time with all relevant documentation.

Proceedings Before DRT
Step 02

We represent clients through the full DRT process — filing written statements, examining witnesses, presenting evidence, and making final arguments. We also assist with interim relief applications, including stays on recovery proceedings.

SARFAESI Proceedings
Step 03

Banks frequently initiate SARFAESI action alongside DRT proceedings. We advise on available remedies under the SARFAESI Act, including applications under Section 17 before the DRT, and coordinate the defence across both forums.

Appeals Before DRAT and High Court
Step 04

DRT orders may be challenged before the Debt Recovery Appellate Tribunal. DRAT decisions may be further challenged before the High Court. We represent clients at both appellate levels with thorough written and oral submissions.
